In California, four (4) different kinds of restraining orders are available:
A domestic violence restraining order can be obtained if a person has abused you and if you have a close relationship with the person. You must either be married, have dated or be blood related to the alleged abuser. Roommates and coworkers do not count as people who have a close relationship with you.
A civil harassment restraining order can be obtained if the harassment is caused by a person with whom you do not have a familial or close relationship. Harassment is defined as the threat of violence, the act of violence, or any actions that scare, annoy, or impede your day-to-day life. These actions must be purposeful. This type of restraining order protects an individual from neighbors, roommates, coworkers, and other people.
An elder or dependent adult restraining order can be obtained for an individual who is 65 years of age or older, or if the person is between 18 and 64 and has disabilities. A person can ask for this order if they are the victim of neglect, abandonment, physical or financial abuse, and the treatment has been physically or mentally hurtful.
A workplace violence restraining order can be filed if you are the employer and if the order is made to protect one of your employees who have experienced violence, or the threat of violence, at your place of work.
